Section 905IAC1-42-8. Adjudication of dismissals, demotions, and suspensions

  •    (a) A nonprobationary officer who has been notified of a dismissal, demotion, or suspension may, within fifteen (15) days of receipt of the written notification, petition the commission for a hearing.

      (b) Commission hearings shall be conducted pursuant to the Administrative Orders and Procedures Act, IC 4-21.5. A nonprobationary officer may be represented at the hearing by legal counsel or by a lay representative.

      (c) An adverse decision of the commission is subject to judicial review under the Administrative Orders and Procedures Act, IC 4-21.5.
