Section 905IAC1-18-1. Determination of residential district

  •    Whereas, I.C. 7.1-1-3-38, defining a "residential district" designates "an area composed of all territory within a radius of five hundred (500) feet of the premises described in the application", but does not provide the method of measuring the area; the Commission adopts the following rules for such measurements to be applied as provided in the aforesaid statute, to-wit: A point directly in the center of the part of the building, room, or premises proposed to be licensed, shall be the "center", and a full circle within a radius of five hundred (500) feet shall be measured therefrom. The areas therein shall compose the territory considered in determining whether same is a "residential district" or not.
