Section 760IAC2-14-2. Advertising

(a) Every insurer, health care service plan, or other entity providing long term care insurance or benefits in Indiana shall provide a copy of any long term care insurance advertisement intended for use in Indiana whether through written, radio, or television medium to the commissioner of insurance of this state for review and approval by the commissioner. In addition, all advertisements shall be retained by the insurer, health care service plan, or other entity for at least three (3) years from the date the advertisement was first used.
(b) The commissioner may exempt from subsection (a) any advertising form or material when, in the commissioner's opinion, subsection (a) may not be reasonably applied.
