  •    (a) The commissioner may after notice and opportunity for a hearing, withhold, suspend, or revoke the registration of a program or the approval of an instructor or director if the commissioner finds that the director or instructor has made a material misrepresentation on the application for program approval, on the application for program director approval, or on the certificate of pre-licensing course completion.

      (b) The commissioner may, after notice and opportunity for a hearing, deny, suspend, or revoke the license of an applicant or agent if the commissioner finds that the applicant or agent has made a material misrepresentation on the certificate of pre-licensing course completion.

      (c) As used in this section, the term "material misrepresentation" means a false or misleading statement of fact or the omission of any fact which if known to the commissioner, would be cause to suspend, revoke, or refuse to grant approval or certification under this rule, or which would otherwise render such person or organization ineligible for the approval or certification for which application was made.
