Section 560IAC2-3-9. Dismissal

   If any motion in the nature of a motion to dismiss the complaint in its entirety is granted by the hearing examiner, the hearing examiner shall make findings and conclusions in support of his ruling and forward the case to the board. The hearing examiner shall file the original of these findings and conclusions with the board and cause a copy thereof to be served upon each of the parties. The filing of the findings and conclusions shall operate to transfer the case to the board. Any further proceedings shall be in conformity with 560 IAC 2-3-22 [section 22 of this rule] and 560 IAC 2-3-23(a) and (b) [section 23(a) through 23(b) of this rule].
