Section 511IAC7-32-46. "Homeless students" defined

  •    "Homeless students" has the meaning given the term "homeless children and youths" in the McKinney-Vento Homeless Assistance Act, as amended, 42 U.S.C. 11431 et seq. The term means individuals who lack a fixed, regular, and adequate nighttime residence, and includes the following:

    (1) Children and youths who are:

    (A) sharing the housing of other persons due to:

    (i) loss of housing;

    (ii) economic hardship; or

    (iii) a similar reason;

    (B) living in:

    (i) motels;

    (ii) hotels;

    (iii) trailer parks; or

    (iv) camping grounds;

    due to the lack of alternative adequate accommodations;

    (C) living in emergency or transitional shelters;

    (D) abandoned in hospitals; or

    (E) awaiting foster care placement.

    (2) Children and youths who have a primary nighttime residence that is a public or private place not designed for or ordinarily used as a regular sleeping accommodation for human beings (within the meaning of 42 U.S.C. 11302(a)(2)(C)).

    (3) Children and youths who are living in:

    (A) cars;

    (B) parks;

    (C) public spaces;

    (D) abandoned buildings;

    (E) substandard housing;

    (F) bus or train stations; or

    (G) similar settings.

    (4) Migratory children, as such term is defined in the Elementary and Secondary Education Act of 1965, who qualify as homeless because the children are living in circumstances described in subdivisions (1) through (3).
