Section 50IAC9-1-9. Fund use prohibited for interscholastic or extracurricular activities

   (a) The capital projects fund may not be used with respect to a facility or equipment that will be used primarily for interscholastic or extracurricular activities. Generally, outdoor spectator seating and lighting for night use of an outdoor facility are considered to be primarily for interscholastic or extracurricular use.

  (b) If payment from the capital projects fund is allowable for the construction of a facility or the purchase of equipment (or would have been allowable if there had been a capital projects fund at the time of the construction or purchase), then payment from the fund is allowable for repair, replacement, or remodeling of the facility or for repair or replacement of the equipment.
