  •    (a) Any applicant or eligible individual who is dissatisfied with any determination or action taken by the VR program that denies, limits, or otherwise affects his or her vocational rehabilitation services may request a review of the disputed determination or action through mediation or an impartial due process hearing.

      (b) An applicant or eligible individual must submit a request for review to the VR program. The request for review must be received by close of business no later than twenty (20) days after the date of the notification of the determination or the effective date of the action, whichever is later.

      (c) For purposes of this section, "close of business" means 4:30 p.m., local time, on the business day where the appeal is received. If the twentieth day is either a:

    (1) Saturday;

    (2) Sunday;

    (3) state holiday; or

    (4) day the VR program is closed during regular business hours;

    the request for review must be received by close of business the next business day. A request for review received after the close of business on the twentieth day is untimely.
