Section 410IAC33-2-1. Right of entry

  •    (a) The state inspector is authorized to enter a school or state agency building, either rented or owned by the state, at reasonable times upon presentation of credentials to do any of the following:

    (1) Inspect facilities, equipment, or records.

    (2) Investigate complaints.

    (3) Conduct tests.

    (4) Collect samples to obtain information required under this article.

    (5) Determine whether any school or state agency [sic, is] in violation of this article.

      (b) The state inspector shall investigate a complaint even if the school or state agency subject to the complaint has addressed or resolved the issues in the complaint.

      (c) The state inspector may investigate any condition that it reasonably believes is contributing or could contribute to poor IAQ regardless of whether a complaint has been filed. (Indiana State Department of Health; 410 IAC 33-2-1; filed Apr 13, 2011, 11:18 a.m.: 20110511-IR-410090682FRA)
