Section 410IAC15-1.6-5. Psychiatric services

                    (a) If the hospital provides psychiatric services, the service shall meet the needs of the patients served, within the scope of the service offered, in accordance with acceptable standards of practice.

                    (b) The service shall be under the direction of a physician qualified by training or experience.

                    (c) The service shall be staffed in accordance with hospital policies and with applicable state and federal rules.

                    (d) If the service provided includes a psychiatric unit exempt from the Medicare prospective payment system, it shall comply with 42 CFR Part 412, Subpart B, section 412.25 and CFR Part 412, Subpart B, section 412.27 for the purposes of licensure.

                    (e) If the service provided includes a subacute short term stabilization program provided in a group home setting as provided for in IC 12-22-2-3 [IC 12-22-2-3 was repealed by P.L.143-2011, SECTION 31, effective July 1, 2011.], this article will apply with the exception of 410 IAC 15-1.5-8.
