Section 405IAC2-8-1.1. Claims against estate; exemption

  •   1. (a) This section applies only to real property owned by the individual at the time of death that was conveyed to the individual's survivor through joint tenancy with right of survivorship.

      (b) The office may enforce its claim against property described in subsection (a) only to the extent that the value of the recipient's combined total interest in all real property described in subsection (a) subject to the claim exceeds seventy-five thousand dollars ($75,000).

      (c) This section expires January 1, 2008.
