Section 35IAC1.2-6-18. Prosecuting attorneys' retirement fund (PARF) disability benefits

  •    (a) A participant receiving disability benefits under IC 33-39-7-17 who has attained normal retirement age, as defined in 35 IAC 1.2-1-4, is not required to be reexamined for a disability determination.

      (b) A participant receiving disability benefits under IC 33-39-7-17 whose disability is a degenerative disease unlikely to improve over time, as reviewed by INPRS, is not required to be reexamined for a disability determination.

      (c) A benefit payable under IC 33-39-7-15 is considered a retirement benefit when the participant reaches normal retirement age, as defined in 35 IAC 1.2-1-4.

      (d) For the administration of disability claims under IC 33-39-7-17, a licensed treating physician of the member may be designated by INPRS as a physician appointed by the board of trustees. However, such designation shall not entitle the treating physician to remuneration or other compensation paid from INPRS unless there is an express written agreement signed by the parties in advance of any compensable services provided by the treating physician.
