Rule 329IAC9-1. Applicability; Definitions |
Section 329IAC9-1-1.1. Interim prohibition for deferred UST systems

1. (a) No person shall install a UST system listed in section 1(c) of this rule for the purpose of storing regulated substances unless the UST system, whether of single-wall or double-wall construction, meets the following requirements:
(1) The UST system prevents releases due to corrosion or structural failure for the operational life of the UST system.
(2) The UST system is:
(A) cathodically protected against corrosion;
(B) constructed of noncorrodible material;
(C) steel clad with a noncorrodible material; or
(D) designed in a manner to prevent the release or threatened release of any stored substance.
(3) The UST system is constructed or lined with a material that is compatible with the stored substance.
(b) Notwithstanding subsection (a), a UST system without corrosion protection may be installed at a site that is determined by a corrosion expert not to be corrosive enough to cause the UST system to have a release due to corrosion during its operating life. The owner and operator shall maintain records that demonstrate compliance with this subsection for the remaining life of the tank.
