Section 329IAC3.1-2-14. Appeal determinations; by whom made

The SWMB shall make one (1) of the following determinations in connection with every appeal from the initial denial of a request for an existing, located record:

(1) The record must be disclosed.

(2) The record must not be disclosed, because a statute or a provision of this rule or 329 IAC 6.1 so requires.
