Section 329IAC10-35-1. Operation approval

   (a) A newly constructed restricted waste site Type III or construction/demolition site that holds a valid permit under this article must not accept solid waste until it has complied with the applicable preoperational requirements of this rule.

  (b) The owner or operator of the restricted waste site Type III or construction/demolition site shall notify the commissioner in writing when all the preoperational requirements have been completed. Unless the commissioner denies operational approval within twenty-one (21) days of receipt of the notice, the facility may begin to accept solid waste in accordance with its permit granted under 329 IAC 10-11 and the requirements of 329 IAC 10-36.
