Section 327IAC5-3-3. Requests for modification, revocation and reissuance, or termination

  •    (a) If a discharger with a permit or an interested person believes that a modification, revocation and reissuance, or termination of a permit is justified under the standards of 327 IAC 5-2-16, he may request such action on the permit from the commissioner in writing. The request shall set forth all facts or reasons known to the requester which may be relevant to a decision thereon.

      (b) If the commissioner agrees, as a result of a request, that the modification, revocation and reissuance, or termination of a permit is warranted, the commissioner shall formulate a draft permit under 327 IAC 5-3-6.

      (c) If the commissioner decides that a request submitted under subsection (a) does not appear to meet the requirements of 327 IAC 5-2-16, the commissioner shall reply in writing to the discharger (and the person making the request, if different) briefly setting forth in writing the reasons for that decision. Such denials of requests for modification, revocation, and reissuance, or termination of a permit are not subject to the public notice, comment, and public hearing provisions of this rule (327 IAC 5-3).
