Section 327IAC19-2-39. "Sensitive area" defined

  •    "Sensitive area" means a site where conditions exist that pose a specific water quality threat to one (1) or more of the following:

    (1) Aquifers used as a source of drinking water.

    (2) Public water supply wells.

    (3) Wellhead protection areas.

    (4) Drinking water supply reservoirs.

    (5) Areas requiring special protection, such as:

    (A) wetlands, except for wetlands constructed for manure management;

    (B) karst terrains;

    (C) the critical habitat of an endangered species; or

    (D) natural areas, including:

    (i) parks;

    (ii) nature preserves, as regulated under IC 14-31;

    (iii) historic sites, as defined in section 21 of this rule; and

    (iv) public lands, as defined in IC 14-38-1-5.
