Section 327IAC5-3-5. Permits required on a case-by-case basis

(a) Various sections of 327 IAC 5-4 allow the commissioner to determine, on a case-by-case basis, that certain facilities, e.g., concentrated animal feeding operations and particular facilities covered by general permits may be required to obtain individual NPDES permits because of their significant contribution to water pollution or other reasons.
(b) Whenever the commissioner decides that an individual permit should be required under this section, he shall inform the discharger in writing of that decision and the reasons underlying it and shall include an application form with such notice. The discharger must apply for a permit in accordance with 327 IAC 5-3-2 and 327 IAC 5-2-3 within ninety (90) days of a receipt of such notice.
