Section 327IAC19-16-3. Closing the operation

   (a) A CFO may be removed from the regulated confined feeding approval program and completely closed if the department has been notified that:

(1) all livestock animals are removed from the site; and

(2) the CFO decommissioned all manure storage facilities in accordance with 327 IAC 19-15-2, including the removal of all manure.

  (b) A CFO will not be allowed to exit the CFO program until all manure generated during the time the CFO was regulated has been disposed of or land applied in accordance with this article.

  (c) The commissioner shall send the owner/operator a letter of confirmation when the department has verified that the requirements of subsection (a) have been met. (Water Pollution Control Division; 327 IAC 19-16-3; filed Feb 6, 2012, 2:58 p.m.: 20120307-IR-327090615FRA, eff Jul 1, 2012)
