Section 31IAC5-9-9. Long-term disability; "disability" defined

  •    (a) Except as provided in sections 20(4) and 27 of this rule, for the first and second year, the long-term disability benefit is available if the employee is unable to perform work consistent with his or her classification.

      (b) The long-term disability benefit is available for a third and fourth year if the employee is unable to perform the work of any occupation for which he or she is reasonably qualified by reason of education, training, or experience.
