Section 312IAC2-2-2. Emergency actions by commission officers

   (a) The chair (or, if the chair cannot be contacted, the vice chair) and the secretary of the commission may jointly take an action for which the commission has authority where both of the following are established:

(1) There is an emergency.

(2) Irreparable harm would result if action were delayed until the next meeting of the commission.

  (b) An action under subsection (a) shall be set forth in writing on a document that:

(1) indicates who entered the order; and

(2) bears the signature of at least one (1) of the participants.
