Section 312IAC2-1-3. Withdrawal of an item from a board agenda

  •    (a) Except as provided in subsection (b), the director or a deputy director may withdraw an item from a meeting agenda at least forty-eight (48) hours before the meeting is scheduled to begin. Notification of the withdrawal shall be delivered to the following address:

    Indianapolis, Indiana 46204-2200.

      (b) An administrative law judge or hearing officer for the commission may withdraw an item, placed by that person on a commission meeting agenda, at least forty-eight (48) hours before the meeting is scheduled to begin.

      (c) A board may remove an item from an agenda if a withdrawal is not performed under subsection (a) or (b).
