Section 170IAC1-1.5-2. Pending proceeding

   For purposes of this rule, a proceeding is considered pending from thirty (30) days before the date of filing until the date the commission issues a final order in the proceeding and until:

(1) all petitions for rehearing or reconsideration and all appeals to a court of appellate jurisdiction have been determined or decided;

(2) any opportunity for a further appeal has been exhausted; and

(3) no further action is required by the commission.
